1. Agreement to Terms
These Terms of Use govern your access to and use of the Collekt website and platform services. By accessing or using our services, you agree to these Terms.
2. Nature of Services
Collekt provides technology infrastructure and operational support services to licensed entities.
Collekt does not act as a lender and does not provide consumer credit, debt advice, or regulated debt collection services in the United Kingdom.
Clients remain responsible for ensuring that their use of the Platform complies with applicable financial services and consumer protection regulations in their jurisdiction (including FCA and RBI frameworks where applicable).
3. Client Responsibilities
If you are a Client using the Platform:
- You warrant that you have the lawful right to upload and process data within the Platform.
- You remain the Data Controller for any personal data uploaded.
- You are responsible for regulatory compliance in your jurisdiction.
4. Operational Support
Certain technology development and operational support services are provided by our wholly-owned subsidiary, Collekt Tech LLP (India), under confidentiality and data protection agreements consistent with UK law.
5. AI and Sub-Processors
- To deliver platform functionality, Collekt may utilise third-party infrastructure and AI sub-processors (e.g., secure cloud providers).
- Processing occurs under enterprise agreements.
- Client data is not used to train public AI models.
- Sub-processors are bound by confidentiality and data protection obligations.
- A current list of sub-processors is available upon request.
6. Intellectual Property
- The Collekt platform, algorithms, models, and derived system-level insights remain the intellectual property of Collekt Limited.
- Client-specific data within isolated environments remains the Client’s confidential information.
7. Limitation of Liability
- To the fullest extent permitted by law, Collekt’s total aggregate liability arising out of or related to the Services shall not exceed the fees paid in the six (6) months preceding the event giving rise to the claim.
- Nothing in these Terms excludes liability where it cannot legally be excluded.
- Collekt shall not be liable for indirect, incidental, or consequential losses.
8. Governing Law
These Terms are governed by the laws of England and Wales.
